Effective Date: July 21, 2026
Last Updated: July 21, 2026

Welcome to TruLiving Foundation (“TruLiving,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our website located at trulivingfoundation.org (the “Site”).

BY ACCESSING OR USING THE SITE, YOU AGREE TO THESE TERMS. If you do not agree, do not use the Site.

1. Eligibility
The Site is not directed to children under 13. By using the Site, you represent that you are at least 13 years old. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Site. Donations should be made only by adults (or with adult permission and supervision).

2. Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted on the Site and reflected in the “Last Updated” date. If we make material changes, we may provide additional notice (for example, by a prominent notice on the Site or by email if we have your contact information). Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

3. Site Purpose; Permitted Use
The Site is provided for informational and charitable purposes. You agree to use the Site only for lawful purposes and in accordance with these Terms.

You agree not to:

use the Site in any way that could disable, overburden, damage, or impair it or interfere with others’ use;
attempt to gain unauthorized access to the Site, accounts, systems, or networks;
probe, scan, or test the vulnerability of the Site or breach security or authentication measures;
use bots, scrapers, or automated means to access or collect data from the Site without our express written permission;
introduce viruses, malware, or other harmful code;
infringe any intellectual property or other rights of TruLiving or any third party; or
use the Site for any unlawful, misleading, or fraudulent purpose.

4. Intellectual Property
The Site and all content and materials on it (including text, graphics, logos, photographs, and brand assets) are owned by TruLiving or its licensors and are protected by applicable intellectual property laws. Except as expressly permitted by TruLiving in writing, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any portion of the Site or its content.

5. Donations
If you make a donation through the Site, you authorize our third-party payment processor to charge your selected payment method for the amount you specify.

Third-party processing. Donations are processed by a third-party payment processor, and your donation may be subject to that processor’s terms and privacy practices.

Refunds. Donations are generally nonrefundable, except where required by law or where we determine, in our reasonable discretion, that a refund is appropriate (for example, in the event of an error, duplicate charge, or suspected fraud).

Tax information. TruLiving Foundation is a 501(c)(3) nonprofit organization. Donations are tax-deductible to the extent permitted by law. No goods or services are provided in exchange for contributions unless explicitly stated. Our EIN will be included on donation receipts. You are responsible for retaining donation records and consulting your tax advisor regarding deductibility.

Recurring donations (if offered): If you enroll in recurring donations, you authorize us (through our processor) to charge your payment method on a recurring basis until you cancel. You may cancel recurring donations by using the cancellation method provided during checkout or by contacting us at [email protected]. Cancellation requests apply prospectively.

6. User Submissions (If You Provide Them)
If the Site allows you to submit content (for example, messages, testimonials, photos, or other materials) (“Submissions”), you represent that you have all rights necessary to provide the Submissions and that they do not violate any law or third-party rights.

You grant TruLiving a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, host, store, reproduce, modify (for formatting), publish, display, and distribute your Submissions in connection with operating, promoting, and improving TruLiving and the Site.

We may remove or refuse to post any Submissions at any time.

7. Copyright Complaints (DMCA)
If you believe content on the Site infringes your copyright, please send a notice to [email protected] with: (a) your contact information; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and its location on the Site; (d) a statement that you have a good-faith belief the use is not authorized; and (e) a statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorized to act on the owner’s behalf.

8. Third-Party Links
The Site may contain links to third-party websites. We do not control and are not responsible for third-party sites, content, products, services, privacy practices, or terms. Links are provided for convenience and do not imply endorsement.

9. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated by reference. Please review it carefully.

10. Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRULIVING DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components, or that any content is accurate, complete, or current.

11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRULIVING AND ITS FOUNDERS, DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRULIVING’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

12. Indemnification
You agree to defend, indemnify, and hold harmless TruLiving and its founders, directors, officers, employees, volunteers, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating of or relating to: (a) your access to or use of the Site; (b) your violation of these Terms; (c) your violation of any applicable law, rule, or regulation; (d) your infringement, misappropriation, or other violation of any intellectual property, privacy, or other rights of any person or entity; or (e) any Submissions you provide (if applicable). TruLiving reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.

13. Suspension and Termination
We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Site. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Venue) will survive.
14. Governing Law; Venue
These Terms and any dispute arising out of or relating to the Site or these Terms will be governed by the laws of the State of California, without regard to conflict of laws rules.
You agree that any legal action or proceeding arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Riverside County, California (or, if no federal court sits there, the nearest federal court), and you consent to the personal jurisdiction of those courts and waive any objection based on inconvenient forum.
